    Question by Nils: Beat someone up who was untrained, fair or not?
    I was recently in a grappling tournament and won. I also do wrestling right now in high school. I’ve been doing kyokushin karate since I was 8. This guy who heard I had won the grappling tournament randomly came up to me and said “yo do you the shit they do in the ufc?” I said “Yup, but I’m not nearly as good.” He then said “show me a dragon kick” I said “I have no idea what that is”, then he said “UFC isn’t shit if you know how to street fight” and started making fun of marital arts while his friends laughed. one of my friends said I could easily kick his ass and this guy making fun of mma, feeling threatened, wanted to fight me outside to see if he could kick my ass. I insisted that if we wanted to fight that he do it after school and i could show him my gym. he tried striking me then and I really didn’t like this guy, so I put him to sleep very, very easily. I was also very angry at this guys disrespect, so I soccer kicked him once and broke his ribs. Now I’m being charged for assault and battery…Was it fair given the circumstances?
    Dave – As I tried convincing him to come back to the gym so we spar with gear, he pushed me and while i stumbled back, he tried punching me. A complete asshole huh? But yeah I agree, the kicking was uncalled for.

    Shouldn’t have kicked him. That got you the assault charge and it should have. Do they teach you to kick unconscious opponents in your dojo?

      Legally it is fair. You both mutually agreed to fight each other. You had a choice not to fight this guy. If the guy out of the blue attacked you, then you have a case for self defense. I see where you are coming from. This guy in question was kind of asking for it. Anyone who makes fun of martial arts is either a really tough guy or quite ignorant of what could happen to him should he fight one. Still, you didn’t have to fight the guy. You could have walked away. Next time someone makes fun of you or your martial arts, then let it be. Beating them up isn’t going to change things or make him a smarter person.

      Both of you learn from your error, what’s the reason that I say it?

      You give him some lessons by kicking and physically hurting him, on such matter you shows your capability and it do broke his ribs, so in his minds, dealing with you is not an easiest matter at all.

      But, he also gives you something to learn from your mistake, hurting and battering someone with physical evidence is something you need to validate in front of the court if why you did such action, you can’t clarify such as self defense because what he did is just an oral assault which may serve as your reasons, from which such is not acceptable things that you need to do some contacts in return of what he did.

      A little story I have to share to you;

      So many times that I received an insult, intimidation and so many words stating that my skills is not enough against them, yet I know they are just a person who hold a bottle of liquors which make them brave enough to say those words.

      I just throw them a little smile and walk away, because of such behavior of keep ignoring them, now they just throw some respect in return because I talk to them not in higher tone.

      He attacked first, but you went overboard and kicked him while he as down. You’ll probably get the worser charge of the two dropped then get a minimal sentance on the other one. No jail or juvy hall time. Maybe some community service(assuming this is your first offense). Next time, just lullaby his ass and that’s it.

      It was unfair. It was also illegal, since you agreed to the fight and street fighting is illegal.

      I’ve said this many, many times before.

      There are other ways of dealing with idiots like these.

      When he asked if you wanted to fight, you should have said something witty like ‘Nah, I don’t fight girls’.

      If he had attacked you then and there then you could have legally defended yourself. If he just walked away, then you have taught him. If he kept coming back, you could of just being a smart ass back.

      So technically, you deserve those charges, however if you had known the above info you would not be facing such things.

      Remember, if you fight every person who annoys you, one day your luck will run out. That’s a good way to die early.

      If he just assaulted you, you can defend yourself, I know that much. But in this case, you mutually agreed to have a street fight, and you damaged him more than he did to you, so you will probably get the worse charge as mentioned above somewhere. I can’t really say it is fair to blame you because he did attack you before you got to the gym, but you shouldn’t have even agreed to fighting in the first place. Karate teaches discipline and self-control, so you shouldn’t really fight people who run their mouths like that. Then, KICKING him when he’s down, that is completely against the principles of Karate man. But anyhows congrats on your victory, but c’mon man, Karate teaches a lot more than how to kick peoples ass. But good luck, and the prick got what he deserved.

      You had the right to defend yourself, which you did.

      Once you defended yourself, you attacked (the kick to the ribs), that’s why you are getting charged with assault.

      Regretfully, the laws are made to favor the attacker, unless you have witnesses/cameras proving you are innocent.

      you were well within reason until you kicked him. tell the cops it was accidental and you had ‘tunnel vision’ and you were scared for your life b/c he could have seriously hurt you. it was you or him and you chose yourself!

      Two things: Kicking the dude while he’s down was stupid.
      WHERE THE HELL WERE YOUR FRIENDS ON THIS ONE? You could have made a made a case for self defense. Instead of accepting a bullshit charge why didn’t you get someone (family member) to help you file a case?

      But to answer your question: If the dude is threatening my life, I dont’ give a shit how untrained he is.

      a fight consented to is ok, he could not have given consent while unconscious.

      you deserve to be punished, and are definitely not a martial artist. do you think georges st pierre breaks peoples ribs when they are unconscious?
      you acted like a criminal and should be treated as such. you should not be allowed in any self respecting dojo

      Well I am 5’7 140 pounds and 17 years old, I wanted to fight someone, I picked a fight with a 13 year old 5’4″ 100 pound kid who never had a fight in his life and in Gym Class lost in wrestling to a 95 pound kid in less than 10 seconds, When I pushed him he did not want to fight, I then grabbed him and pulled him on top of me, He then agreed to the fight and wrestled me to the ground, Got me under control and the hit me in the ribs and gut alot then sat on top of me and hit me in the jaw 20 times and KOd me,

      I challanged him 4 more times and he KOd me each time
